Terms of Service

Effective date: July 21, 2026

1. Agreement

These Terms of Service ("Terms") govern your access to and use of ApplySharp at applysharp.net (the "Service"), including the free resume builder, template catalog, account features, digital downloads, and any partner or agency tools we make available.

By creating an account, using the Service, or completing a purchase, you agree to these Terms, our Privacy Policy, and our Refund Policy. If you do not agree, do not use the Service.

2. The Service

ApplySharp provides tools to enter professional profile information, preview resume and cover letter layouts, and download PDF packages. Some layouts are free. Paid layouts and related digital entitlements are sold as one-time digital products at the prices shown at checkout.

ApplySharp provides design templates and software tools only. We do not guarantee interviews, job offers, salary outcomes, ATS compatibility with every employer system, or recruiter preferences. You are solely responsible for the accuracy and legality of content you enter and for how you use downloaded files.

3. Accounts

You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account. Notify us promptly at support@applysharp.net if you suspect unauthorized access. We may suspend or terminate accounts that appear abusive, fraudulent, or in violation of these Terms.

You must be old enough to form a binding contract in your jurisdiction (and at least 16, or the higher age required locally) to use the Service.

4. Your content

You retain ownership of the resume, cover letter, and profile content you submit. You grant ApplySharp a limited license to host, process, display, and export that content solely to operate the Service for you (including previews, PDF generation, and account storage).

You represent that you have the rights needed to submit the content (including photos and third-party names used as references) and that your content does not violate law or others' rights.

5. Template license

When you lawfully obtain a template (free or paid), ApplySharp grants you a non-exclusive, non-transferable, worldwide license to use the template files and generated PDFs for:

  • Your personal job search and professional self-presentation
  • Single-client professional use if you are an individual career coach or similar practitioner preparing materials for one client at a time under your own practice

You may not:

  • Resell, redistribute, sublicense, or share template source files as templates
  • Publish template files in stock, marketplace, or "free download" libraries
  • Use the Service or templates to build a competing template product
  • Remove proprietary notices from files where those notices appear
  • Claim ownership of ApplySharp's underlying layout designs beyond the license above

Agency or partner programs may include additional seat, branding, or credit rules presented in those portals. Those rules supplement these Terms.

6. Purchases and pricing

Paid templates are sold as one-time digital downloads at the listed package price. After you own a paid template, downloading a fresh package after profile edits may require a separate revision fee. Unlocking a different paid template you do not already own may require a switch fee. Claiming the free Plain template does not unlock paid switch pricing. Exact amounts are shown at checkout and may change for future orders.

Prices are generally displayed in the currency presented at checkout. Taxes may apply based on your location and payment processor rules. Payment is handled by Stripe. You authorize Stripe and ApplySharp to charge the selected payment method for the amounts disclosed at checkout.

7. Refunds

Digital sales are final after delivery. Except where required by law or expressly allowed in our Refund Policy, we do not provide refunds, returns, or charge reversals once ownership is granted or download access is issued.

8. Acceptable use

You agree not to:

  • Attempt to access others' accounts, scrape the Service in an abusive way, or probe for vulnerabilities without permission
  • Interfere with Service integrity, rate limits, or payment systems
  • Upload malware, unlawful content, or content that infringes intellectual property or privacy rights
  • Misrepresent your identity to obtain complimentary access, coupons, or chargebacks in bad faith
  • Use automated systems to create accounts or checkouts at a volume that harms the Service

We may investigate and take technical or legal action, including suspension, in response to violations.

9. Intellectual property

The ApplySharp name, branding, site design, software, and template layouts are owned by ApplySharp or its licensors and are protected by intellectual property laws. Except for the limited license in Section 5 and your ownership of your own content, no rights are granted by implication.

10. Third-party services

The Service relies on third parties such as Stripe for payments and infrastructure providers for hosting, authentication, and storage. Their terms and privacy practices apply to their processing. We are not responsible for third-party outages beyond our reasonable control, though we will try to restore Service availability.

11. Disclaimers

THE SERVICE AND ALL TEMPLATES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APPLYSHARP AND ITS OPERATORS, AFFILIATES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR ANY PURCHASE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID TO APPLYSHARP FOR THE TRANSACTION GIVING RISE TO THE CLAIM IN THE THREE MONTHS BEFORE THE CLAIM, OR (B) TWENTY-FIVE U.S. DOLLARS (US$25).

Some jurisdictions do not allow certain limitations. In those places, our liability is limited to the fullest extent permitted.

13. Indemnity

You agree to defend, indemnify, and hold harmless ApplySharp and its operators from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your content, your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.

14. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, if required by law, or if we discontinue the Service. Provisions that by their nature should survive (including licenses already granted for lawfully obtained files, payment obligations, disclaimers, and limitations) will survive termination.

15. Changes

We may update these Terms from time to time. The effective date will change when we do. Continued use after changes become effective constitutes acceptance. If you do not agree, stop using the Service.

16. Governing law

These Terms are governed by the laws of the United States and the state in which the ApplySharp operator maintains its principal place of business, without regard to conflict-of-law rules, except where mandatory consumer protections in your place of residence require otherwise. Exclusive venue for disputes not subject to a mandatory consumer forum lies in the state and federal courts serving that principal place of business, unless applicable law requires a different forum.

If any provision is found unenforceable, the remaining provisions remain in effect. These Terms are the entire agreement between you and ApplySharp regarding the Service and supersede prior conflicting understandings on the same subject.
